What is export clearance?

The Export Clearance is a customs process that must be followed if any goods or articles are exported outside the European Union. This documentation control is necessary regardless of whether you are a company or an individual. The Export Customs Clearance is managed by the Customs and Special Taxes Department of the Tax Agency (AEAT). Customs will require a series of data from you as the exporter (seller), as well as from the article and the person who bought it (importer), to approve the exit of your product from Spain. All the export clearance formalities can be submitted online or in person at the AEAT offices.

The export customs process is divided into the following phases:

  • Filing of the customs declaration.
  • Supervision of the declaration to assess the risks.
  • Authorization of the release of the goods


You must present the customs declaration and other papers requested by the Spanish customs to perform an export customs clearance.


Necessary Documentation

To clear the goods for export, the following documents must be presented and processed:

  • Pro forma invoice: the exporter issues this temporary document for the items he has shipped and sends it to the customer. Like the commercial invoice.
  • Commercial invoice: the exporter includes basic information that allows the buyer to pay the value of the transaction. Customs documents are used to determine whether items should be taxed upon entry into the country.
  • Customs Invoice: A document required by customs in certain importing countries and must be provided by the seller of the goods.
  • Carriage documentation: depending on the means of transport used to ship the goods it will be a Sea Bill of Lading (B/L), a FIATA Multimodal Bill of Lading, a Railway Bill of Lading (CIM), an Air Waybill (AWB), or a Road Bill of Lading (CMR).
  • Product List: commercial document prepared by the exporter containing information on all packages, boxes, or shipments, as well as weight and contents.
  • Single Administrative Document (SAD): standard document used to make the export declaration that is included in the Customs Code of the Union (CUC). It contains information about product characteristics, origin, and destination.

Some importers require the Certificate of Origin to be provided in order for the shipment to reach its destination country. This certificate, issued by the Spanish Chambers of Commerce, confirms that the products originate in Spain or have been processed in Spain.


Additional Procedures

Each product or commodity must be correctly classified with a tariff code prior to export to determine what duties and other taxes should be imposed. The tariff classification of a product is determined by the “International Convention on the Harmonized Commodity Description and Coding System” of the World Customs Organization or by the Common Customs Tariff of the EU. In addition, in Spain, the exporting company must be registered in the Special Registry of Economic Operators and receive an EORI number, which is granted by the Tax Agency to an economic operator to be able to export. In addition, there is an Exporter Registration System (REX system) for exporting companies. This is a simplified method that allows the registered exporter to “self-certify” the preferential origin of the goods on the invoice or other commercial document associated with the shipment.
